1.    About These Terms and Conditions

These Terms and Conditions, together with our Shipping Policy, Warranty, Returns and Replacement Policy, and Privacy Policy, set out the terms governing the relationship between you and About Space Pty Ltd, trading as About Space.

By using our website, purchasing our products, or engaging with our services, you agree to be bound by these Terms and Conditions.

About Space may update these Terms and Conditions from time to time by
publishing the updated version on its website.

Any changes will apply from the date of publication for future orders and future use of the website. Changes will not apply retrospectively to orders already accepted by About Space unless the change is required by law or is administrative only and does not materially adversely affect the Buyer.

If a change is required by law, About Space may apply that change to the
extent required.

Any changes will take effect once they are published through one or more of the following methods:

  • Publishing the updated Terms and Conditions, or relevant sections, on aboutspace.net.au; or
  • Displaying amended terms related to specific promotions or offers in About Space showrooms or other relevant channels.

2. Disclaimer

About Space makes every effort to ensure the accuracy of all product images, specifications, drawings, descriptions, weights, dimensions, and promotional materials published on our website and other channels. Much of this information is supplied by manufacturers and suppliers. As such, About Space reserves the right to correct or amend any information on the website where errors or inaccuracies are identified.

These amendments may occur at any time and without prior notice, including after a purchase has been made where correction is reasonably necessary. Nothing in this clause excludes, restricts or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law.

While we strive to present accurate product images and descriptions, minor variations between website imagery and the actual product may occur due to factors such as lighting conditions, photography, and monitor or device display settings. Returns requested due to such variations will be treated as change-of-mind returns and are subject to the applicable return terms and conditions.

About Space also reserves the right to withdraw or discontinue products from the website at any time due to reasonable circumstances, including but not limited to supplier issues, quality concerns, or product availability. In some cases, this may require us to cancel an order even after an order confirmation has been issued. Should this occur, we will notify you and provide an appropriate refund where applicable.

About Space will not be liable for any loss, inconvenience, or damages resulting from the removal, amendment, or unavailability of products, content, or materials on our website, or from the cancellation of orders where necessary.

All transactions processed through aboutspace.net.au are conducted in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable.

2.1 Colour

Product images on this website are either photographed by About Space or provided by our manufacturers. Please note that colour appearance may vary depending on factors such as ambient lighting during photography and the calibration of your screen or device. While we aim to present an accurate representation of each product, images should be considered a guide only, and About Space accepts no responsibility for minor colour variations.

2.2 Glass

Many glass components are handmade, and as such, small air bubbles, slight imperfections, and minor colour variations may occur as part of the glassblowing process. These characteristics are natural and contribute to the uniqueness of each piece.

2.3 Timber

Timber is a natural material, and variations in grain, colour, and texture are to be expected. No two pieces of timber are identical, and these natural differences form part of the character of the product.

2.4 Consultations & Design

Lighting consultations and design guidance provided by About Space are intended for general advisory purposes only. Any recommendations or opinions are offered in good faith, but without warranty as to their completeness or accuracy.

Any sketches, plans, or conceptual designs provided are illustrative only and must be reviewed and approved by qualified electrical, engineering, or construction professionals before implementation.

About Space does not provide structural or electrical engineering services and cannot be held responsible for the technical feasibility, safety, or compliance of any design once implemented. It is the responsibility of the client to ensure that all designs and installations comply with relevant building codes, fire regulations, health and safety requirements, and local legislation.

2.5 Custom Items

Orders for custom-made, non-standard, or special-order items are not eligible for change-of-mind return.

Custom-made, non-standard, or special-order items cannot be cancelled once production has commenced or materials have been ordered, except as required by law.

If About Space agrees to a cancellation, About Space may retain the deposit paid or charge a cancellation fee equal to the lesser of:

(a) 50% of the order value; and

(b) About Space’s reasonable costs and losses actually incurred as a result of
the cancellation, including supplier charges, materials ordered, labour already performed, administration costs, and any loss in value where the goods cannot reasonably be resold.

Nothing in this clause excludes, restricts, or modifies any rights or remedies the Buyer may have under the Australian Consumer Law.

3.    Terms & Conditions for Sale Items

  • Sale items are offered at the advertised sale price as displayed in promotional materials, on our website, and as ticketed in About Space showrooms.
  • Sale pricing is available only for the
    advertised promotional period and cannot be applied retrospectively. If a
    purchase is made prior to the commencement of a sale, no price adjustment, refund, or discount will be provided.
  • Additional promotions, offers, or discounts cannot be used in conjunction with sale pricing unless otherwise specified.
  • Custom-made or special-order items are excluded from sale promotions.
  • Sale pricing applies to purchases considered to be standard residential quantities. About Space reserves the right to decline sale pricing for bulk or commercial orders.
  • Sale items are not eligible for return or
    refund due to change of mind, unless required under Australian Consumer Law.

4. Vouchers & Credits

Gift vouchers issued prior to November 2019 are valid for 12 months from the date of issue. Gift vouchers issued from November 2019 onwards are valid for 3 years from the date of issue, in accordance with Australian regulations.

Please note that gift vouchers and store credits cannot be redeemed through the About Space online store and are valid for use in About Space showrooms only.

Store credits are valid for 12 months from the date of issue, unless otherwise stated. Unused balances after the expiry date will no longer be redeemable.

5. Product Availability

About Space Lighting is committed to providing exceptional customer service and high-quality products. We endeavour to ensure that all products listed on aboutspace.net.au are accurately represented in terms of pricing and availability.

For in-stock items, standard dispatch timeframes are typically 10–14 business days. If an item you have ordered becomes unavailable, or we are otherwise unable to fulfil your order, we will notify you within 3 business days to discuss suitable options. These may include arranging a backorder, selecting an alternative product, or providing a full refund where appropriate.

6. In Store Pickup Policy

Orders placed using Click & Collect should be collected within four (4) weeks after the Buyer is notified that the order is ready for collection.

If an order is not collected within that period, About Space may move the goods to warehouse storage and may charge the Buyer any reasonable storage, handling, or return-to-stock costs actually incurred.

If an order remains uncollected after further reasonable notice to the Buyer, About Space may cancel the order and refund any amounts paid less any reasonable storage, handling, freight, and restocking costs actually incurred by About Space.

Nothing in this clause excludes, restricts, or modifies any rights or remedies the Buyer may have under the Australian Consumer Law.

7. Shipping & Delivery

About Space ships orders Australia-wide and to select international destinations.
For in-stock items, orders are typically dispatched within 10–14 business days
from receipt of payment or purchase order. In some circumstances, dispatch
times may exceed this timeframe depending on stock availability, order volume, or delivery location within Australia.

For orders to New Zealand or other international destinations, please contact us at info@aboutspace.net.au with the items you are interested in and the
delivery address so we can provide a shipping quotation. Customers may also
arrange their own freight if preferred. Please note that any customs duties, taxes or import fees applicable to international orders are the responsibility
of the buyer.

7.1 Important Notice for Australia-Wide Orders

Please inspect all goods on delivery before arranging installation.

While we make every effort to ensure timely delivery, About Space Lighting cannot accept liability for delays caused by circumstances outside our control, including courier delays or third-party service providers. We are also not responsible for any expenses incurred due to delayed delivery, including costs associated with electricians or other contractors.

7.2 Delivery Information

Deliveries are generally made during business hours and a signature may be required upon delivery. If no one is available at the delivery address, the courier may attempt redelivery or leave a card with instructions for collection from a nearby depot or pickup location. 

7.3 Delivery Risk

Unless otherwise agreed, freight charges are the responsibility of the Buyer.

If the Buyer arranges its own carrier, freight forwarder, or collection agent, risk in the goods passes to the Buyer when the goods are collected from About Space or handed to the Buyer’s nominated carrier.

If About Space arranges delivery, the Buyer should inspect the goods as
soon as reasonably practicable after delivery and notify About Space promptly
if goods are lost, damaged, incomplete, or incorrect so that About Space can
investigate and assist.

Nothing in this clause excludes, restricts, or modifies any rights or remedies the Buyer may have under the Australian Consumer Law.

7.4 Shipping Returns

If a courier is unable to successfully deliver a parcel and it remains uncollected or undelivered for two weeks, it may be returned to About Space.

In the rare event that a parcel is returned due to an error on our part, such as an
incorrect address or shipping service being selected, we will promptly reship
the order to the correct address at no additional cost.

However, if a parcel is returned due to incorrect delivery details, failure to collect the parcel, or other inaction on the part of the buyer, About Space reserves the right to charge the buyer for any costs incurred. This may include, but is not limited to:

  • Return-to-sender freight charges incurred by About Space
  • Storage or handling fees (if applicable)
  • The cost of reshipping the parcel to the correct address

These charges must be paid prior to the parcel being reshipped.

Delivery Issues, Buyer Responsibilities & Installation Advice

Customers are advised to arrange installation only once all goods have been delivered and inspected to confirm that they are correct, complete, on time, and free from any visible damage

7.5 Installation Booking and Third-Party Costs

About Space recommends that installation appointments are booked only after all goods have been delivered, inspected, and confirmed to be correct and apparently undamaged.

To the maximum extent permitted by law, About Space is not liable for electrician fees, contractor fees, access equipment costs, rescheduling charges, delay costs, or similar third-party expenses incurred because the Buyer booked installation before receiving and inspecting the goods, unless and to the extent that such loss was caused by About Space’s breach of a non-excludable guarantee and was reasonably foreseeable.

7.6 Installation Access and Height

The Buyer is responsible for ensuring that the installation location is safe, suitable and accessible for installation and any later inspection, repair or replacement work. This includes arranging, at the Buyer’s cost, any scaffolding, scissor lifts, elevated work platforms, ladders, permits, traffic management, or other access equipment required for the installation.

About Space does not assess, supply, arrange or supervise installation access equipment or installation methods.

Where products are installed at height, in voids, on stairwells, in double-height spaces, or in any other location requiring
non-standard access, the Buyer is solely responsible for ensuring that access
can be obtained safely and lawfully and that installation is carried out by appropriately qualified contractors.

To the maximum extent permitted by law, About Space is not liable for additional labour costs, access equipment hire, contractor fees, rescheduled works, delays, or other costs arising from site conditions, restricted access, installation height, or the Buyer’s failure to make
appropriate access arrangements.

Nothing in this clause excludes, restricts or modifies any rights or remedies the Buyer

7.7 Errors or Inaction by the Buyer

The following situations may, at the discretion of About Space, be considered an error or inaction on the part of the buyer and may affect eligibility for returns, refunds, or reshipment:

  • Providing an incorrect or incomplete delivery address, including failing to include a business name where delivery is intended for a commercial premises.
  • Failing to collect or arrange redelivery of a parcel within two weeks of a delivery attempt and notification card being issued by the courier.

If an order is returned to About Space due to the above circumstances and the Buyer chooses to cancel the order, About Space may refund amounts paid less any
reasonable shipping, handling, storage, return-to-stock, and restocking costs
actually incurred.

7.8 Inspection & Notification on Delivery

The Buyer should inspect the goods as soon as reasonably practicable after delivery or collection. If packaging is visibly damaged, items are missing, or the incorrect item has been supplied, the Buyer should notify About Space promptly and, where possible, within 3 business days, and provide photographs and any other reasonably requested information. Prompt notice assists About Space to investigate the issue with carriers, warehouses and suppliers.

7.9 Transit Damage / Incorrect Supply

Where a claim relates to visible transit damage, shortage, or incorrect supply, delayed notification may affect About Space’s ability to investigate the claim as a delivery or fulfilment issue. However, nothing in this clause limits or excludes any rights the Buyer may have under the Australian Consumer Law.

7.10 Faults Discovered After Delivery

If a product is faulty, not of acceptable quality, not fit for purpose, or not as described, the Buyer’s rights are governed by the Australian Consumer Law and any applicable voluntary warranty. About Space may assess the goods before determining the appropriate remedy.

8. Change of Mind Returns & Refunds

8.1 No Obligation for Change of Mind

Under the Australian Consumer Law,
About Space is not required to provide a refund or exchange where the
buyer has:

  • Changed their mind;
  • Selected the incorrect product; or
  • Failed to consider or acknowledge the estimated delivery lead time displayed prior to completing the purchase.

8.2. About Space Goodwill Policy

While not required to do so, About Space may, at its discretion, offer the following goodwill policy to assist customers.

Where a request for cancellation or return is made under the circumstances described in Section 8.1 and is approved by About Space, a store credit may be issued equal to the value of the goods excluding any shipping or handling costs.

Store credits are valid for 12 months from the date of issue and may be redeemed in About Space showrooms only.

Refunds will not be provided in these circumstances unless required under the Australian Consumer Law.

8.3. Conditions for Approved Change-of-Mind Returns

Any change-of-mind return is at About Space’s discretion and will only be considered if:

(a) the item is a standard stocked item;

(b) the return is requested within [30] days of delivery or collection;

(c) the item is unused, uninstalled, unmodified and in original saleable
condition, with all original packaging, components and manuals;

(d) proof of purchase is provided; and

(e) the return is approved in advance by About Space.

About Space may reject a change-of-mind return request where any of the above conditions are not met.

8.4. Excluded Items

Custom-made, made-to-order, non-standard, special-order, clearance, final-sale and sale items are not eligible for change-of-mind return, exchange or refund.

Nothing in this section excludes, restricts or modifies any rights or remedies the Buyer may have under the Australian Consumer Law.

9.    Returns, Replacements & Warranty – Goods

All About Space products are supplied with a limited warranty, details of which are outlined on our website, quotations, and invoices.

Please note that where a refund is approved, including in cases of change-of-mind returns, it will generally be issued in the form of a store credit, unless otherwise required under the Australian Consumer Law.

9.1. LED Bulbs

LED bulbs supplied by About Space Lighting carry a 3-year back-to-base replacement warranty, unless otherwise stated.

9.2. Non-LED Bulbs

Non-LED bulbs carry a 2-year warranty, unless otherwise specified. While we may provide manufacturer information regarding the expected lifespan of bulbs, About Space does not guarantee the actual operating life of a bulb.

9.3. Products with Non-LED Components

Products that include non-LED components are covered by a 1-year limited warranty, unless otherwise stated.

This warranty covers manufacturing defects under normal use and does not apply to damage resulting from improper installation, misuse, modification, or normal wear and tear. Warranty claims may require the product to be returned for inspection.

9.4. Warranty Scope

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

For the purposes of this agreement:
9.4.1. Major Failure
A major failure occurs where the goods:

  • Would not have been purchased by a reasonable consumer had they been fully aware of the nature and extent of the issue;
  • Differ significantly from their description, sample, or demonstration model;
  • Are substantially unfit for a purpose for which goods of that kind are commonly supplied and cannot easily or within a reasonable time be remedied to make them fit for that purpose; or
  • Are unsafe.

9.4.2. Minor Failure

A minor failure occurs where the issue can be remedied within a reasonable time
and does not otherwise constitute a major failure. In such cases, About Space
may choose to repair, replace, or otherwise remedy the goods within a
reasonable timeframe.

These rights are in addition to, and do not limit, any rights or remedies available under the Australian Consumer Law.

9.5. Warranty Service

If an issue with a product does not constitute a major failure under the Australian Consumer Law, About Space will work to resolve the issue within a reasonable timeframe. The appropriate remedy will be determined by About Space and may include:
Repair of the goods;

  • Replacement with goods of the same or comparable type and value; or
  • Issuing a store credit equal to the value of the goods, valid for 12 months, where agreed with the buyer.

Where it is unclear whether the issue relates to the product itself or the installation, About Space may request that the buyer engage a qualified electrician to inspect the installation.

In some cases, About Space may, at its discretion, arrange for an independent electrician to attend the premises to assess the installation or assist in resolving the issue.

9.6. Aesthetic Variations

Some materials and finishes may naturally display variations in colour, texture, pattern, or surface character, such as marbling, veining, or patina. These variations are inherent to the material and form part of the product’s natural character.

Such variations are not considered defects and do not constitute grounds for return, replacement, or warranty claim, except where required under the Australian Consumer Law.

9.7. Compensation for Minor Defects

Where the buyer agrees to retain goods that have a minor defect, About Space may, at its discretion, offer compensation to reflect any reduction in value. This
compensation may be provided as a partial refund or a store credit for a future
purchase, as agreed between About Space and the buyer.

Nothing in this clause limits or excludes the buyer’s rights under the Australian Consumer Law, including rights relating to goods that are faulty, damaged, not as described, or that constitute a major failure.

Important Information for Warranty Claims:

  • Please ensure the product is within the
    applicable warranty period before submitting a warranty claim.
  • Proof of purchase will be required for all warranty claims.
  • Where applicable, a Certificate of Compliance confirming installation by a licensed electrician may also be required.

Please ensure these documents are available when submitting a warranty claim to assist us in processing your request efficiently.

9.8. Warranty Coverage

This warranty is subject to the following conditions:

  • The warranty is valid only within Australia.
  • The product must be installed by a qualified and licensed electrician in accordance with relevant electrical and safety standards.
  • Products must be operated within the
    permissible limits specified in the applicable technical specifications,
    including voltage, temperature, and environmental conditions.
  • Where installation occurs in extreme or
    unusual environmental conditions, written approval must be obtained from About Space prior to installation. Failure to obtain written consent may void the warranty.
  • The product must not be subjected to unintended mechanical stress, chemical exposure, or misuse.
  • The stated warranty period is based on a maximum operating usage of 4,000 hours per year.
  • This warranty does not apply to damage orfailure caused by misuse, abuse, abnormal operation, installation contrary to instructions, or events beyond reasonable control (Force Majeure).
  • A mortality rate or mean time between
    failures (MTBF) of up to 0.2% per 1,000 operating hours is considered normal and is not covered under warranty.
  • A nominal reduction in luminous output of LED modules of approximately 0.6% per 1,000 operating hours is considered normal and is not covered under warranty.
  • Colour variations or tolerances in LED
    modules are not covered under this warranty.
  • Actual luminous output and efficacy may vary by ±10% from published specifications, including those stated in brochures, product data sheets, or on the website.
  • For subsequent deliveries of the same
    product, minor variations in design, light output, or performance may occur due to product updates or technological improvements. Such variations do not constitute a defect and are not covered under this warranty.
  • This warranty will be void if the product has been repaired, modified, or altered by any party not authorised in writing by About Space.

About Space reserves the right to determine the validity of any warranty claim in accordance with these conditions and the requirements of the Australian Consumer Law.

9.9. What Is Not Covered by This Return, Replacement & Warranty Policy

This policy does not apply to:

(a) Superficial blemishes, minor imperfections, or reasonable variations in colour, texture, finish, or dimensions that do not affect the performance, function, or safety of the product;

 (b) Natural variations in materials, such as marbling, veining, patina, or timber grain, which are inherent characteristics and contribute to the uniqueness of the
product; or

 (c) Minor differences between product images, display samples, or demonstration models and the delivered goods, provided the product otherwise matches its description and meets acceptable quality standards.

Returns requested for the reasons outlined above will be treated as change-of-mind returns and handled in accordance with Section 8 of these Terms and Conditions.

Nothing in this clause excludes or limits the buyer’s rights under the Australian Consumer Law, including rights relating to goods that are faulty, not as described, or not of acceptable quality.

9.10. Balance of Warranty

To the maximum extent permitted by law:

  • Where goods are repaired or replaced with refurbished goods, the warranty will continue for the remainder of the original warranty period, calculated from the date the original goods were collected or delivered.
  • Where goods are replaced with new goods, a new warranty period will commence from the date the replacement goods are collected
    or delivered.

Nothing in this clause limits or excludes the buyer’s rights under the Australian Consumer Law, which apply independently of any voluntary warranty provided by About Space.

9.11. How to Make a Warranty Claim

To make a claim under this voluntary warranty, the Buyer must submit a claim online.

The Buyer must provide proof of purchase, details of the issue, photographs or videos where reasonably requested, and, where relevant, evidence that installation was carried out by a qualified and licensed electrician.

About Space may require the goods to be made available for inspection, testing, return or collection before determining the claim.

If About Space accepts the claim under this voluntary warranty, About Space will, at its option and subject to the Australian
Consumer Law, repair the goods, replace the goods, or provide another remedy
available under the warranty. About Space will also advise whether it will
reimburse any reasonable expenses associated with the claim and the process for claiming those expenses.

10. Product Compliance

Where required by law, in-scope electrical equipment supplied by About Space will be supplied in compliance with applicable Australian electrical safety and
regulatory requirements, including the Electrical Equipment Safety System
(EESS) and Regulatory Compliance Mark (RCM) requirements.

The Buyer acknowledges that compliance is assessed by reference to the product as supplied by About Space. Any alteration, modification, substitution of components, incorrect installation, or use
outside the product specifications may affect compliance, safety, and warranty
coverage. 

11. Customer Conduct

About Space is committed to maintaining a safe, respectful, and professional environment for both our team and our customers. Aggressive, abusive, or threatening behaviour, whether in person, by phone, email, or online, will not be tolerated.

Where such behaviour occurs, About Space reserves the right to:

  • Refuse service;
  • Cancel orders or suspend customer accounts; and
  • Take any other action reasonably necessary to protect the wellbeing of staff and the integrity of the business.

Nothing in this clause limits or excludes the buyer’s rights under the Australian Consumer Law.

12. Limitation of Liability

To the maximum extent permitted by law, and except where doing so would render any part of these Terms illegal, void, or unenforceable, About Space, including its
directors, employees, and representatives:

  • Excludes all conditions and warranties that may otherwise be implied into these Terms;
  • Is not liable for any loss or damage, however caused (including through negligence), that may be suffered directly or indirectly in connection with the use of this website; and
  • Excludes liability (whether arising in
    contract, tort including negligence, or under statute) for any special,
    indirect, or consequential loss or damage, including but not limited to loss of revenue, loss of opportunity, or loss of or damage to data, arising from the use of this website.
  • Without limiting the above:
    About Space does not guarantee the accuracy, completeness, or currency of any material published on this website, nor does it warrant that the material is fit for any particular purpose.
  • About Space will not be liable for any errors, omissions, or outdated information.
  • About Space will not be liable for interruptions, disruptions, or temporary unavailability of the website.
  • About Space is not responsible for any interference with, or damage to, computer systems that may occur in connection with the use of this website or any linked external websites. Users should take their own precautions to ensure that any material downloaded from the website is free from viruses or other harmful components.

About Space accepts no responsibility for the actions, services, or representations of third-party businesses referenced or linked on this website. Additionally,
About Space is not responsible for any inaccurate or misleading information
posted by individuals who are not employees or authorised representatives of the company.

Nothing in this section excludes, restricts or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law.

13. Installation by a Qualified Electrician – Limitation of Liability

  • About Space, including its directors and employees, accepts no responsibility for the installation, modification, or electrical connection of its products or associated fittings.
  • It is the customer’s responsibility to ensure that all electrical installation and modification work is carried out by a qualified and licensed electrician.
  • All installations must comply with relevant Australian Standards and electrical regulations, and the method of installation remains the responsibility of the installing electrical professional.
  • Incorrect installation or modification may result in equipment malfunction, electrical hazards, property damage, serious injury, or death.
  • When installing lighting products, customers must ensure that electrical wiring and circuitry are appropriate and compliant. If a product is connected to a circuit shared with other fittings, About Space will not be liable for any faults, compatibility issues, malfunctions, or damages arising from such wiring arrangements.

Nothing in this section excludes or limits any rights that cannot be excluded under the Australian Consumer Law.

13.1Compliance with Applicable Laws

The Buyer is responsible for ensuring that the installation, location, and use
of the goods comply with all applicable laws, codes, standards, and regulatory
requirements in the state or territory where the goods are installed or used

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Victoria, Australia, and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies the Buyer may have under the Australian Consumer Law or any other law that cannot be excluded.

15. Customer Responsibility and Indemnity

The Buyer indemnifies About Space against any loss, liability, damage, cost, or expense reasonably incurred by About Space arising from:

(a) the Buyer’s breach of these Terms and Conditions;

(b) installation, modification, use, or maintenance of the goods otherwise than by a qualified and licensed electrician or otherwise than in accordance with
applicable instructions, standards, or laws;

(c) any incorrect information, measurements, specifications, delivery details, or instructions provided by the Buyer; or

(d) the Buyer’s failure to ensure safe and lawful access to the installation site, except to the extent that the loss was caused or contributed to by About Space’s breach of law, negligence, or supply of goods that do not comply with a non-excludable guarantee

16. Intellectual Property

Unless otherwise stated, all content
on the About Space website and in About Space materials, including text,
images, photographs, renders, drawings, plans, logos, trade marks, product
names, graphics, layouts, and design content, is owned by or licensed to About
Space and is protected by applicable intellectual property laws.

The Buyer must not reproduce,
publish, adapt, distribute, display, or use any such content for commercial
purposes without About Space’s prior written consent.

 The supply of goods, sketches, plans,
concepts, quotations, or design guidance does not assign or transfer any
intellectual property rights to the Buyer unless expressly agreed in writing.
